Aliment Solicitors in Scotland

Divorce brings about much change in your and your family’s life, and finances are more than likely to be tied to this too. Sometimes during the separation, one partner may require continued financial support from the other spouse until they are settled and established with the change. In Scotland, this is known as an aliment.

When is Aliment Awarded?

When deciding whether to grant aliment, the court will look at various factors to decide how much should be paid, if any. The court will consider:

  • The resources and needs of each party.
  • Individual circumstances of each case.
  • The parties’ income and expenditure.

There are instances where it can be argued that aliment should be awarded, where the resources of the parties can allow for this. The court will require evidence from the party seeking aliment as to why they need financial support and will seek evidence from the alternative party to establish if they have the means to provide said support. If the party paying the aliment feels they do not have the resources to pay the awarded amount, the court will require evidence. The aliment should not extend beyond what the paying spouse can reasonably afford.

Periodical Allowance

Periodical allowance is the maintenance payment after divorce that can be issued in Scotland. Although not common, they are not unheard of. Typically, when awarded, they will be for a fixed term after divorce and will not be extended beyond three years.

Change in Circumstances During Aliment Payments

After aliment has been awarded, there is always the chance that your circumstances can significantly change. This includes redundancy or a change in work hours, which can also lead to aliment being needed when it previously was not required.

Aliment orders can be amended after they have been awarded to account for this or created later as long as it is before the divorce is finalised.
